Applying the Malaysian 'real danger of bias' test and considering all circumstances, the judge found no cogent or convincing evidence that exposure to the Protasco Suit created a real danger he would unfairly favour or disfavour any party in the present action; the Protasco Suit and this action involve different facts and parties, the presumption of impartiality stands, the applicants failed to discharge the legal burden to justify recusal, and therefore the recusal application must be dismissed.
