The consent order in Suit 171 could not be set aside because the Plaintiff was not a party to that suit and therefore lacked locus standi; the consent order was recorded after judicial mediation with counsel who had authority to bind D5, making the order binding; and setting it aside would affect the interests of a third party (Bangsar Heights Pavilion) not joined to this action. As a result, the court limited relief to awarding damages against those found to have conspired/misconducted (D2, D7 and D8) rather than nullifying the consent order or transfers.
