The Court of Appeal found triable issues existed as to whether KFH breached contractual and/or tortious duties by delaying issuance of a compliant performance bond and that a final finding of gharar was premature on affidavit material; balance of convenience favoured appellants because CCRIS classification would cause irreparable commercial prejudice to Emrail and guarantors while the respondent's prejudice was monetary and compensable; accordingly the High Court's refusal of interim relief was set aside and injunctions granted pending trial.
