The High Court found a real doubt that the appellant’s guilty plea was conditional and that procedural irregularities occurred in the Sessions Court; using its section 31 supervisory powers the High Court interfered: it set aside the Sessions Court conviction and ordered a retrial, and allowed the appeal against the Magistrate resulting in acquittal and release. The court retained the RM10,000 Sessions Court bail conditions and ordered the RM5,000 Magistrate bail returned.
