Section 17 Part III is interpretive and applies where there is no known or acknowledged father; it does not impose a legitimacy requirement that defeats the primary rule in Article 14(1)(b) read with Section 1(b) Part II that a child born abroad to a Malaysian father acquires citizenship by operation of law. Denying transmission in these facts would produce unjustifiable gender and illegitimacy discrimination contrary to Article 8, so the child is entitled to Malaysian citizenship by operation of law from birth.
