The High Court held that the Sessions Judge erred in treating the invoices and statement of account as conclusive proof of the debt because they were unsatisfactory, lacked particularisation, lacked evidence of service or acknowledgement and raised triable issues (including suspicion of fraud); accordingly summary judgment was inappropriate and the case must go for full trial.
