The Court held the 1845 indenture remained a public charitable trust; the 1994 partition and subsequent orders did not convert it into a private trust; therefore appointments of new trustees and transfers/vesting of trust land effected without the Attorney General's written consent under s.9 GPA were unlawful and of no legal effect; the transfer to Five Star and the 2007 order approving the JVA were set aside and the titles were to be vested in the surviving original trustee, subject to undertakings and control pending AG consent or further order.
