The court applied the inherent jurisdiction (ex debito justitiae) and held the impugned 23 February 2017 order was susceptible to being set aside because it operated in a manner contrary to the substantive provision of s.76 LR(MD) Act 1976; therefore the court had jurisdiction to set aside that order and grant remedial orders to restore the Defendant's proprietary position and award half the sale proceeds.
