On the balance of probabilities the court found objective technical and contemporaneous evidence established interference (direct bypass wiring and high clamp meter readings), the defendant was the registered consumer and liable under s.38(3) ESA without proof of personal involvement or knowledge, the inspection was lawful without prior notice or post-inspection disclosure obligation in the circumstances, and the Maximum Demand Load (BKM) method properly applied produced a corrected recoverable sum of RM26,146.70 which the court awarded with costs and interest.
