The Court held R2 had jurisdiction to hear and award damages arising from inter-floor leakage by operation of s.105(1) SMA read with Part 1 of the Fourth Schedule and r.61 of the SMA Regulations; the award was not shown to be illegal, perverse or procedurally unfair and factual findings of the Tribunal cannot be overturned by judicial review in absence of perversity, therefore the judicial review application is dismissed.
