On the balance of probabilities the court accepted the contemporaneous documentary and ledger evidence and reliable witness evidence that the RM2.6M transferred by KBO to CP in 2013 was repayment of director's loans owed to the plaintiff under an oral agreement in 2012 repayable on demand; CP was thereby unjustly enriched and must make restitution, with interest and costs.
