The writ filed without the required endorsement/statement of claim was a fundamental irregularity and a nullity under Order 6 r 2(1)(a) ROC; an interlocutory injunction cannot stand in the absence of a pleaded pre‑existing cause of action; the plaintiff's complaints concerned corporate governance (a corporate wrong) requiring leave under s.347 Companies Act 2016 before a derivative suit could proceed; accordingly the strike out applications succeed and the injunction applications fail; costs awarded RM15,000.
