Because the Defence was filed after office hours it was deemed served the following day under Order 62 r 8 and therefore filed out of time in breach of the SAR direction and mandatory Rule (Order 18 r 2(1)); no sufficient reason was given to justify use of Order 3 r 5, so Plaintiff was entitled to leave to enter judgment in default of defence.
