The court set aside the arbitrator's limited Jurisdiction Award and held that, on construction, Clause 18 together with Clause 24 of the Carbon Casing Contract expressly confer on the Carbon Casing arbitral tribunal jurisdiction to admit and determine Pertama's defence of set-off and counterclaim arising from the Other Contracts; 'liability' in Clause 18 requires a legal obligation and cannot be satisfied by mere unilateral assertion of figures, but the tribunal has jurisdiction to determine entitlement and quantum of those set-off claims.
