Prosecution failed to prove a prima facie case because its case depended on limited witness testimony (SP5/SP3) made under poor visibility, failed to call arresting officers whose evidence was essential, did not exclude access by others to an open unsecured premises, and left investigative gaps and alibi inconsistencies; therefore accused were not called to enter defence and were discharged and freed.
