The writ and warrant were irregularly served and executed and the plaintiff acted mala fide by failing to comply with the Omnibus Order and to pursue judicial sale after judgment; the intervener purchased the vessel as a bona fide purchaser without notice; accordingly the writ and warrant are set aside, stakeholder security must be returned and the plaintiff is liable for wrongful arrest and damages.
