The appeal was dismissed because the appellant's pleadings failed to particularise the alleged conspiracy and misrepresentation and, on the face of the record including the signed application and HPA, the claim was plainly unsustainable under Order 18 r 19; there was no documentary or evidential basis to establish fraud such that non-comprehension of the documents could vitiate the contractual effect of the signed agreements.
