The claim was struck out because D1 had been struck off and thus lacked legal personality and capacity to be sued; Plaintiff failed to obtain reinstatement of D1 or leave to serve out of jurisdiction before commencing proceedings, amounting to abuse of process; there were no pleaded facts of fraud or dishonesty to justify piercing the corporate veil against D2 and privity of contract barred holding D2 liable for the corporate contract; accordingly the strike‑out under Order 18 Rule 19 was justified and costs were awarded to defendants.
