MBMB was not a 'purchaser' within the meaning of BCPA 2007 and therefore JMB had no statutory power to demand payment for 2012–2014 under that Act; accordingly the High Court order requiring MBMB to pay RM715,163.40 is set aside; however amounts paid in 2015 prior to SMA 2013's commencement are recoverable pro rata and partial restitution is ordered.
