Section 7 SRA is confined by subsection (2) and is appropriately read in the context of landlord/tenant holding over; however, the plaintiff acquired legal title on payment and the defendant was in unlawful possession (trespasser/licensee), so the court properly treated the originating summons as one under Order 89 ROC and granted declaratory relief, vacant possession and assessment of damages by the SAR.
