Claims in contract and ordinary tort were time barred because causes of action accrued on 20.5.2012; however the plaintiff's claim in fraud/fraudulent breach of trust fell within Section 22(1) exception and succeeded: Fortitude and its Managing Director Adib were held to have acted dishonestly and are jointly and severally liable for USD 1,303,126.31 with interest and costs; ARB was not liable.
