Because the plaintiffs attended the 23.8.1989 distribution hearing and did not file any timely appeal, their present writ and statement of claim seek to relitigate issues already decided and constitute an abuse of process; accordingly the court allowed Defendant First’s Order 18 Rule 19 application to strike out the writ and statement of claim and awarded costs to Defendant First.
