The plaintiff failed to prove on the balance of probabilities that the defendant owned the iCloud email address or authored/sent the impugned iMessage; the screenshot was only an identification document and the original message was not produced; even accepting the message as capable of being defamatory it was only published to the plaintiff's wife (limited publication); accordingly the claim is dismissed with costs.
