Court held that a person is a 'mentally disordered person' only when so found by due course of law under section 51 of the Mental Health Act 2001, and an inquiry under section 52 is the statutory mechanism to reach that finding; accordingly the plaintiff’s wife could not unilaterally assume the status of litigation representative for the plaintiff without such a declaration, and the claim against Defendant Fourth was properly struck out under the defendant’s application.
