The application is dismissed because Applicants were time-barred under O.53 r.3(6) (grounds arose by latest 26.7.2021) and, in any event, the challenge became academic after DBKL granted a 2024 approval; additionally DBKL lawfully relied on s.101(v) Local Government Act 1976 and national guidelines to authorize GN schemes, and mandamus to remove structures was inappropriate where the scheme had prior lawful approvals and the dispute lies principally in private law.
