The Defendant had no caveatable interest because its Shah Alam suit sought only monetary relief and did not establish a registrable or proprietary interest in the Land under s.323 NLC; consequently the caveat was wrongful under s.329 and Plaintiffs proved a loss of opportunity evidencing a real loss (difference between conservative market valuation with development order of RM17,000,000 and actual sale RM12,300,000), warranting damages of RM4,700,000 and an injunction preventing further caveats.
