The defendants' Order 18 application was allowed because Plaintiff 3 lacked locus standi, the majority resolutions and subsequent statutory steps (formation of three subsidiary management corporations and issuance of certificates) validated the management decisions and rendered the plaintiffs' reliefs academic, there was no evidence of mala fide or breach by the committee members, and the plaintiffs’ delay invoked laches/estoppel; accordingly the claim was a misuse of process and was struck out.
