Defendants failed to demonstrate any bona fide triable issues: the commercial documents constituted a binding contract, the joint and several guarantee unambiguously bound guarantors beyond any initial credit limit, objections about defective goods were unpleaded and unsupported by contemporaneous complaints, and the 1.5% monthly interest was established market practice; therefore summary judgment was appropriate and the plaintiff's application was allowed with costs.
