On the balance of probabilities the High Court found the appellant entitled to higher compensation: the closed comminuted fracture of the left femoral head (Pipkin) and complex left hip dislocation are to be assessed together as injuries to the same anatomical region; the clinical expert's finding of a 2 cm lengthening and ongoing functional deficits was accepted over the scanogram/radiograph in this case; accordingly the Sessions Court awards were varied — general damages increased to RM80,000, future total hip replacement RM20,000, orthopaedic footwear RM49,200 (including quotation), abrasi…
