The court held Encl 9 must be granted: the petitioner established at least a good prima facie case and it is likely the company will be wound up, and there was a real risk to assets because RM93.25 million was admitted to have been transferred to ZIST to defeat LHDN and substantial, suspicious payments (inflated legal/consultancy fees, director payments and redemption of a director's loan) indicate misapplication of award monies; accordingly interim liquidators were appointed to preserve assets and investigate.
