The amended writ and amended statement of claim insofar as they seek to add the 2nd, 3rd and 4th defendants were filed after the six‑year limitation period from the consent judgment and therefore the addition of those defendants is barred by s6(1) Limitation Act; accordingly the amended writ and SOC against those defendants are struck out. Additionally, the present suit is in essence the same as the earlier action and constitutes an abuse of process, reinforcing the strike out result.
