Enclosure 23 was dismissed because the Third and Fourth Defendants invoked the wrong procedural provision (should have proceeded under Order 15 rule 6), sought an inappropriate form of relief by asking to be removed as parties instead of properly seeking strike out under Order 18 rule 19(1), their application was filed with inordinate delay after pleadings closed and after a Discovery Application, and the Plaintiff's claim against them was not plainly or obviously unsustainable; accordingly the application failed and costs were awarded to the Plaintiff.
