The originating summons was dismissed because (1) the plaintiff misnamed the proper land authority which is a fatal defect justifying dismissal, and (2) the Registrar/Land Office acted lawfully in removing and refusing registration of the caveat pursuant to the National Land Code (s326) and s329(2) precludes re‑entry of a caveat on the same grounds; challenges to the exercise of statutory power by the land authority should be pursued by judicial review where appropriate.
