The High Court upheld the Sessions Court finding that PCOM repudiated/breached the BOQ and was liable for defective and delayed works but affirmed that the plaintiff failed to prove the precise quantum of claimed special damages; accordingly plaintiff was entitled only to nominal damages of RM70,000 with interest and reduced trial costs of RM5,450; defendant's cross-appeal was dismissed.
