The court found the Impugned Documents were sham and intended to conceal illegal moneylending: material inconsistencies, lack of documentary proof of payments, non‑production of material witnesses and documents, undervaluation relative to market value and timing anomalies established fraud. Accordingly the Consent Judgment based on the sham tenancy was set aside and the First, Second and Fourth Defendants were held jointly and severally liable for the Deceased's losses; damages (general and exemplary) and aggravated damages were awarded and interest ordered.

On the balance of probabilities the signed agreement between Ong Boon Hoi (in his personal capacity) and the defendant was valid and binding; the defendant received RM947,350 and the transaction was a repayable loan (not an enforceable investment or a business of moneylending by the plaintiff); allegations of fraud and illegality were unproven or afterthoughts and the Moneylenders Act did not render the agreement void; consequently plaintiff is entitled to judgment for RM947,350 with interest at 5% per annum and costs RM8,000.
