The court found that defendants' contemporaneous documentary evidence (SSM searches, loan agreements, mortgage/form 16A and title registered in the company name) sufficiently demonstrated that the plaintiffs had not disclosed a reasonable cause of action and that the claims were frivolous or an abuse of process; accordingly the court exercised its discretion under Order 18 r19 to strike out the plaintiffs' claim and to dismiss the plaintiffs' interlocutory application to examine defendants, and discharged the interim injunction.
