The High Court allowed the appellant's re-heard appeal, finding the pleadings disclose a private law defamation cause (not a judicial review matter), that the Sessions Court misapplied Order 53 and impermissibly relied on affidavit evidence for an O.18 r.19 striking out, and that under amended s.68(1)(f) CJA a High Court decision dismissing a strike-out precludes further appeal to the Court of Appeal; the Sessions Court order dated 15.4.2022 was set aside and the strike-out application dismissed for trial.
