Uncontested affidavit evidence established that the UKAS tranche was disbursed and received by defendant on 4/8/2020, thereby fulfilling the condition in clause 4.1(c); plaintiff established a prima facie entitlement and defendant failed to show any triable defence, so summary judgment for specific performance was appropriate and defendant was liable to pay RM2,000,000.00 for 918,750 shares.
