Applications for stay were dismissed because applicants failed to discharge the burden of proving a valid arbitration agreement with each plaintiff and several defendants were non-parties to any arbitration agreement so s.10 AA 2005 did not apply; permitting stays would produce split litigation, multiplicity of proceedings and risk inconsistent findings; the court exercised its inherent jurisdiction to refuse stays to prevent abuse and ensure just, expeditious and economical resolution; costs awarded RM3,000 each.

Because the plaintiff party that was bound by the arbitration clause (P2) discontinued its action, there remained no arbitration agreement between any plaintiff and any defendant in the suit; absent such an operative arbitration agreement between parties in the proceedings the mandatory stay under section 10 did not apply and the court would not exercise its discretion to grant a global stay to bind non-parties; therefore the stay application (Enc 25) was dismissed.
