The High Court erred in granting unconditional stays because the respondents failed to show special circumstances sufficient to justify stay of execution; payment of the judgment sum into a stakeholder interest-bearing account held by the appellants' solicitors pending final determination of the appeals neutralises the risk of a nugatory appeal and is the appropriate order; thus the unconditional stays were set aside and substituted with the stakeholder payment order and costs.
