On the cumulative evidence the SPAs and attendant LOPs were sham instruments disguising illegal unlicensed moneylending; the Moneylenders Act 1951 protects borrowers so appellants are not in pari delicto; the SPAs are void and unenforceable; the High Court was plainly wrong and the appeals are allowed with damages remitted to the High Court.
