Acceptance of RM30,000 and clear representations by UiTM created a legitimate expectation that Plaintiff would be released for optional retirement; UiTM breached mandatory procedures under Act 605 (improper service, failure to obtain HOD report, failure to notify appeal outcome and give reasons) and failed to consider Plaintiff's explanations; those procedural defects and failure to give effect to the legitimate expectation rendered the disciplinary and appeal decisions (18.12.2015 and 1.6.2017) invalid, entitling Plaintiff to declaratory relief and pension benefits as if retired 31.8.2014.
