High Court upheld the Sessions Court's order for discovery under O.24 r.10 because the plaintiffs identified documents or classes of documents logically connected to pleaded facts (letters, banker’s cheques, client account statements) and showed relevance and possession/power by D4; however the consequential order requiring plaintiffs to file a Reply/Defence to Counterclaim after receipt of documents (paragraph (c) of the 2.8.2023 order) was set aside because any amendment or further pleading should be made by application under O.20 r.5, not by the discovery order.
