The Addendum Order is invalid because it was not made in compliance with Article 42: the house arrest terms were not deliberated or advised upon at the Pardons Board meeting presided by the YDPA; therefore the Respondents have no duty to implement it and mandamus cannot be granted; further, house arrest as ordered is not an executable mechanism under the Prisons Act and Regulations which vest release on licence in the Commissioner General.

Majority held the unsigned Addendum copy was credible fresh evidence obtained with reasonable diligence, admissible on appeal against an interlocutory dismissal; the evidence negated the hearsay finding, established the existence of an Addendum Order affecting appellant's liberty, and satisfied the low threshold for leave to apply for judicial review; matter remitted to High Court for substantive hearing; respondents' failure to disclose amounted to lack of candour and estopped them from denying existence.

The Court of Appeal allowed the appeals, holding that the prerogative of mercy under Article 42 is not subject to the supervisory jurisdiction of the courts in the manner advanced by the respondent; the respondent lacked locus standi and a cause of action to challenge the pardon by writ; the High Court erred in refusing to strike out the claim; the writ and amended statement of claim were struck out as frivolous and an abuse of process.

The High Court held the Plaintiff had sufficient locus standi to challenge the validity of the full pardon, the grant of pardon by the YDPA when made on advice of the Pardons Board and AG is justiciable, there are triable issues (not suitable for summary dismissal under Order 18 Rule 19), and therefore the Defendants' strike-out applications were dismissed and the matter proceeded to full trial.
