The Court held that clauses 13.1 and 15.3 of the contract constituted clear representations that the plaintiffs owned the copyright/patent in the colour code and that the defendant required prior written consent before appointing any third party; even if the contractual term had a one-year duration and the contract expired, the defendant was estopped from denying those representations and therefore could not invite a third party to publish the Mushaf without plaintiffs' written consent; the High Court decision was set aside and the appeal allowed.
