PGB was permitted to intervene because the Court found its legal and pecuniary rights as paymaster are directly affected by the outcome of the TNB Appeal; under Order 15 r.6(2)(b) ROC 2012 the Court must add a person whose presence is necessary to ensure the subject matter may be effectually and completely determined; accordingly PGB’s intervention was necessary to prevent injustice and to resolve conflicting High Court decisions and Federal Court authorities.
