The Court held the prosecution failed to prove on the civil standard that the seized bank balances were traceable proceeds of an offence under s23 MACC Act or the money‑laundering provisions; where monies transferred by the accused were spent or commingled and no reliable money‑trail linked them to unlawful activity forfeiture under s56 cannot be ordered and s59 pecuniary penalties are not available absent a successful forfeiture; bona fide recipients who received payments for lawful consideration are protected under s61.
