The appeals were dismissed because the Defendants failed to raise any bona fide triable issue: the Plaintiff produced evidence of disbursement and valid demands, established it was a Recognized Market Operator exempt from the Moneylenders Act, the Defendants did not discharge the evidential burden to show illegality or unconscionable interest, the guarantees had consideration within the same agreement and contractual notice provisions rendered demands effective; accordingly summary judgments were properly entered.
