On the balance of probabilities the court found Hadrons discharged its evidential burden: the CSAA and Settlement Agreement (backed by a Federal Court Consent Order) clearly governed entitlement to fees; contemporaneous documents and admissions supported Hadrons' computations; the companies failed to produce direct evidence, withdrew impropriety allegations and could not rebut Hadrons' case; res judicata/estoppel and contractual indemnities applied; accordingly judgment entered for Hadrons in Suit 215 and Suit 227 dismissed.
