Although the publication satisfied the three technical elements of defamation (published, referring to the plaintiff, and capable of defamatory meaning), the defendants proved defences of fair comment and qualified privilege based on police-sourced reporting and public interest; the appellant failed to plead particulars of express malice as required by Order 78 r.3(3) and therefore could not rebut the defences; appeal dismissed and lower court decision affirmed.
